Many companies that once manufactured or used asbestos filed for bankruptcy after facing overwhelming numbers of asbestos-related claims. Rather than resolving those claims individually in court, many of these companies set up trust funds to compensate people harmed by their products or worksites.
Asbestos Ships helps veterans and families understand how these trusts work. We connect you with resources to explore whether a claim may apply to your situation.
An asbestos trust fund is a compensation trust created under Section 524(g) of the U.S. Bankruptcy Code, allowing a company facing major asbestos liability to fund a trust instead of continuing to litigate every claim in court. The trust then takes over responsibility for paying both current and future claimants. Congress created this process in 1994 specifically because asbestos-related diseases can take decades to develop. A trust is meant to preserve funds so people who were exposed years ago, but have not yet gotten sick still have a legal option.
Who May Be Eligible
Trusts each set their own eligibility standards, so passing one doesn't automatically qualify you for the next. A diagnosis alone won't cut it, since every trust also wants documented exposure and supporting evidence before approving anything.
- A qualifying asbestos-related disease, including mesothelioma, lung cancer, or another recognized condition
- Documented exposure connected to that trust's specific products, worksites, or companies
- Exposure that happened within the timing, duration, or location that trust requires
- Medical records confirming your diagnosis
- Evidence of your occupational or military exposure background
- Meeting that trust's filing deadlines and required documentation
How Trust Claims Are Valued
Each trust sets a scheduled value for different disease categories, then applies a current payment percentage to that value. If a trust's scheduled value for a claim category were $100,000 and its current payment percentage were 10 percent, the payment would generally come out to $10,000 before any deductions.
Payment percentages are not fixed and can change as trustees reassess available assets against projected future claims. Because of this, a published disease value should not be treated as a guaranteed payout amount, and actual payouts vary widely by trust and diagnosis.
Filing with Multiple Trusts
Veterans exposed to asbestos through military ships often worked around products from many different manufacturers. That history can make them eligible for claims against more than one trust at the same time.
How many trusts an individual qualifies for depends entirely on their documented work and exposure history, and that number varies significantly from person to person. There is no single figure that applies to every claimant.
Trust Claims and Deadlines
There is no single deadline that applies to every asbestos trust. Each trust sets its own filing requirements and time limits, separate from the statutes of limitations that apply to a lawsuit against a solvent company.
This means a person may have a valid trust claim even if a separate court deadline has passed, or the other way around. Checking each trust's current rules matters more than relying on a general assumption about deadlines.
